Can I Take My Gun on a Road Trip?

Are you planning on taking a road trip soon? If so, you might be wondering if you can take your Glock with you on the road trip. If you have a gun you use for self-defense, you may keep it in the glove compartment when you ride in the car. Then, you may transition it to a holster on your waist when you get out of the vehicle. On the other hand, if you are crossing state lines on your road trip, are you allowed to carry a handgun? There are several key points to keep in mind.

There Is No Nationwide Law For Transporting Firearms

First, understand that there is no nationwide law when it comes to transporting firearms. Therefore, you need to keep up with the rules and regulations and every state in which you travel. In some cases, you may even need to select a different vacation destination depending on how attached you are to your firearm and the laws of that specific area.

Do not assume that a concealed carry permit you have is recognized in all 49 other states. It is true that some states recognize licenses and permits from other states, but if you do not check before you travel, you could find yourself getting fined or arrested.

Furthermore, keep in mind that even if your handgun is legal in your state, it is not necessarily legal in every other state. Similar to concealed carry laws, different states have different laws regarding what weapons are legal and what weapons are illegal. You also need to keep up with changes in magazine regulations and ammunition types. Even if your handgun is legal in a certain state, your ammunition might not be legal. There are a lot of details to keep up with, and you need to make sure you protect yourself accordingly.

What About the Federal Safe Passage Act?

Even though there is no nationwide law that makes rules and regulations easy to remember, there are a few options you have for protection. For example, you may have heard about the Federal Safe Passage Act. This act will provide you with some measure of protection, but it is not a get-out-of-jail-free card.

If you are traveling through one state between your home state and your destination state, you are allowed to have an unloaded firearm and ammunition in a locked container with hard sides as long as it is in your trunk. There are a lot of details, and you need to check every box if you want to protect yourself. Make sure your gun is unloaded, make sure your ammunition and firearms are stored separately, make sure your handgun is in a locked container, the container must have hard sides, and the container must be in your trunk. If you do not meet all of these conditions, and your handgun is illegal in that state, you could get arrested.

What About the Firearm Owners Protection Act?

Another defense you may have available to you is called the Firearm Owners Protection Act, which is usually shortened to FOPA. This act allows you to legally transport your firearms in your vehicle while driving as long as you meet certain criteria. These include:

  • Your handgun must be unloaded, locked in the trunk, and locked in a container that renders it not immediately accessible. This may sound familiar, as it mirrors the Federal Safe Passage Act.
  • Your journey has to start and end in states in which your specific firearms are legal.
  • You need to be traveling through other states. You cannot linger too long in a state that is not your start or end state. This is a bit murky, but don’t overstay your welcome.
